Syeed v Bloomberg L.P.

41 N.Y.3d 446, 235 N.E.3d 351, 211 N.Y.S.3d 819, 2024 N.Y. Slip Op. 01330

Court of Appeals of New York · March 14, 2024

What the court decided

Answering a question from the Second Circuit, the Court of Appeals held that the State and City Human Rights Laws "protect nonresidents who proactively sought an actual New York City- or State-based job opportunity." It read its earlier decision in Hoffman as allowing a nonresident to meet the impact rule in two ways: by working in New York, or by showing that the conduct had some impact on the plaintiff within New York.

Who won

The job applicant won on the question certified. The Court of Appeals answered it in the affirmative, unanimously.

Why it matters for workers with a medical condition

A person turned down for a New York job, or a promotion into one, is protected even if they live elsewhere.
